Main Rules and Conditions in "MAKEALiVE" project
(on the right of agreement with project Participant)

These rules are applied when you are ready to become a participant of "MakeAlive!" system (further "Project"). This project is being offered to you by Buro S.W.A. spol. s r.o., located at Ceskoslovenske armady c.p. 371/11, 160 00, Praha 6 - Bubenec, Ceska Republika (further - "Developer") and any other companies on an agreement with developer.

Please read this up to the end. If you have any questions contact us at rules@makealive.com for explanations. If you don't agree with the rules given below please don't register as a Participant.

1. Accepting present rules and conditions in Project.

Clicking button "accept" you confirm you've read and understood rules completely and agree with rules and conditions of Project. You confirm you are a capable and adult person by your country's law and adequate to a Participant's status according to present rules and appendixes to them.

Project Developers have the right to change present rules any time without special notice. Once the rules are changed, contradicting statements valid for the topic publishing time remain in force and are considered prior.

Developers are obliged to provide free access to rules and conditions of Project through suitable Project site. Rules which haven't been published aren't considered valid.

2. Project Developers.

Main project Developer is Buro S.W.A. spol. s r.o. (info@buroswa.cz). More detailed information about Developer you can find in section „Contact Us“.

While the Project is being set up Developer by his own decision has the right to hire other persons or organizations to work at Project.

Developer is fully liable for fulfilling Project except cases which will be specially defined in present rules and appendixes to them.

3. Project Participant.

Participant can be any adult and capable person by law of his/her country no matter where he/she lives or has residence. Any legal entities, strangers, associations, unions etc cannot participate in Project.

Participants can be people’s unions established without being formally registered and by law(s) of their Participant’s country(ies) are not considered legal entities.

Any person obtains Participant status only after registering. To register he/she is required to fill out the form and pay registration fee. The form is worked out and (or) changed by Developer on his opinion.

Participant status is over automatically if during 30 days starting the registration time no topic is published or time of placing topics in Project is expired.

4. Registering to join Project.

A. Registration.

It is necessary to obtain the Participant status. To get registered you are required to fill out special registration form located on a separate page where you should state the volume of the information to be published about you in the book.

The form is elaborated by Developer and can be changed. According to privacy policy Developer has no right not to allow Participants state that volume of the information except specially defined cases.

When filling out the form Participant is required to fill out boxes indicated by special sign.

Participant is obliged to state true information about the following:

1. name and surname
2. date of birth
3. valid personal e-mail address

Participant has the right to state the volume of personal data to be published about him/her except the following cases:

• if he/she does not agree to publish his/her name and (or) surname, his/her login will be published instead
• country cannot be hidden from publishing.

To be contacted Participant is required to state only his/her e-mail address but not telephone number. He/she can state telephone number and post address for Developer.

Every Participant when registering is required to invent his/her Participant’s name (login) not contradicting point 5A. Login cannot be less than 5 symbols, it cannot contain only figures or diactric signs but Latin letters.

Already registered login is prohibited to use. If login is found out to be repeated when registering Participant will be given a chance to change his/her login.

Registration data is to be kept for not less than 3 years but if Participant is not active – not less than 500 days starting with registration date.

Attention. Each Participant is due to provide a real functioning e-mail address and access to it for the term of placing topics and additional 185 days. Stated e-mail address is considered the main means of contact between Developer and Participant. In case Participant does not receive Developer’s letter, does not read it or does not answer it he/she cannot appeal to absence of possibility to receive information and (or) enquiry from Developer. Participant and Developer admit using other means of communication to be alternative but there is no obligation to use them.

B. Registration fee

After sending registration data to go on with registration Participant should pay registration fee.

Registration fee is set by fares valid at registration time. Paying registration fee is made in accordance with point 6 of present rules.

Paid registration fee allows to place at once only one text topic of minimum volume or one graphical topic in JPEG format up to100Kb. If Participant places his first topic in bigger volume final price of topic placing will be reduced by registration fee amount. Project site will automatically define final price for placing first topic and Participant will be informed about it before going to page for topic paying.

Registration fee paid is never paid back even if Participant doesn’t place topic in term defined and (or) first topic is deleted (refused) to publish according present rules.

5. Placing Topics.

By topic we understand any information placed by Participant on special standards to be published in the book after finishing Project. Graphical topic can be any file containing graphical information in size up to 1 Mb in JPEG format.

A. On placing topics.

1. Placing topics is possible only for registered Participants during specially defined period of time – 365 days starting with official site opening. Within this period Participant has the right to place as many topics as he/she likes.
2. Only personally created topics of Participants are allowed to be published. Participant when placing topic and paying for its publication automatically fully renders all rights including copyrights on the content of his/her topic to Developer who reserves the right on his own opinion to publish it and reproduce it in any form and number, keeping data about the author in the volume stated in registration form. No claims of Participants on owning and (or) deciding on the topics content are considered legal.
3. When placing a topic Participants should state its language. Developers reserve the right to check translations to make sure topic is in accordance with present rules. If translation from stated language is found out to be impossible Developers reserve the right not to publish such topic because of breaching the rules of placing topics.
4. Participant is obliged to observe the following requirements to topics not depending on their content or whether they are text or graphical ones:
   1. topic must not contradict international laws, laws of the Czech Republic and your country, i.e. it must not contain obscene words and expressions offending third parties, claims to violance, discrimination and international enmity, show openly hatred to society and social order, to propaganda of drugs, criminal behavior, alcohol, etc. (if you have any doubts please ask at rules@makealive.com or contact your lawyer).
   2. topic must not contain any type of advertisement of legal entities, sole proprietors, goods and (or) services, trade marks, religious movements, international organizations or parties, social societies, unions and associations, social order and ruling state advertising, etc.
   3. graphical topics must not contain any elements of erotics and (or) pornography, pictures of third persons, reproductions of pieces of art, etc.
   4. file of graphical topic should be made in JPEG format. Its size cannot be more than 1 Mb (1024 Kb). If you want to place a bigger graphical topic or one of different format please contact Developers (topics@makealive.com or on hotline telephone)
   5. no discrimination in topics on any reason is allowed (if you have any doubts contact Developer at rules@makealive.com or consult your lawyer).
5. Already placed topic cannot be edited or deleted by Participant.
6. Developer reserves the right without notice to delete topic if it violates any of present requirements and is represented with such violations.
7. Developer is obliged not to edit or correct topics. All topics placed will be considered „as is“. Developer reserves the right to study topics only to check their accordance to rules.
8. No text topic containing more than 150 lines is allowed to be placed without discussing it with Developer in advance. Please contact Developer at publishing@buroswa.cz.

B. About copyright for placed topics.

Participant accepting given rules and conditions agrees to place his/her topic which content he/she has legal right for and the right to make use of it. If you are not sure in it contact your lawyer.

After having placed topic in special forms and paying for its publishing, Participant automatically renders copyrights for maintaining topic to Developer. Developer is obliged to keep author’s name whenever he uses or copies content in any form.

In case third parties claim for authorship for topic Developer reserves the right to provide information about Participant who placed topic to the extent required by law of the Czech Republic.

Developer is not liable for observing copyright of Participants to third persons. Developer reserves the right at the same time not to publish topic if he finds out real reasons to think Participant places topic he/she has no right for as well as in case Participant refuses to prove it when asked to.

6. Paying registration fee and for placing topic.

Payment is made by credit cards Visa / Master Card and others by payment means rules you can choose on site pages. Developer does not bear responsibility for payment means functioning and their service quality.

Payment is made in USD.

Payment is fulfilled after successful transaction authorisation has been confirmed by payment system message.

Attention! When paying registration fee and for placing topic you approve topic content is in complete accordance with present rules and all appendixes to them. Payment fulfilled is not paid back (even in case topic had been deleted from publishing by Developer).

Paying registration fee and for placing topic in the order stated you approve you have the right to use that payment means and have enough rights to make transactional operations through the payment means.

Price of registration fee and for placing topic are defined by fares valid for the date topic has been entered and is automatically calculated by system before sending topic to project server. On topic placement page you will be informed of its price before payment. You will also have a chance to study fares on special site page.

As Project Participant you’ll be informed on registration page about registration fee amount before registration procedure is over. On topic placing page you’ll be informed about price for its placing before going to pay.

Until topic is not paid for its content can be edited. Fares can be changed by Developer without special notice. Changed fares are valid only for new-entering topics and Participants.

Special fares can be stated for some topics (text topics containing more than 150 lines, graphical topics more than 1 Mb in size and others on Developer’s decision). Please contact directly Developer at topics@makealive.com.

7. Publishing the book.

A. Editing

In case by date project is finished less than 200 000 (two hundred thousand) users with at least one topic are registered, Developer reserves the right to publish book in e-format providing free access to it on the site for 10 years.

If there are more than 200 000 Participants, Developer is obliged to publish book – topics collection on paper.

Book format, ways and order of placing topics in the book, number of copies and all other questions on publishing and distributing the book ( both on paper and electronic ) can be determined and changed by Developer without notice if it is not agreed upon separately in present rules.

No Participant has the right to have copies if it had not been agreed upon by Developer and Participant in written form. When solving this matter references to e-mail messages are not valid.

B. Publishing topics.

Content part of the book will start with co-authors list sorted out by continents, countries, towns / cities, name’s first letter (in Latin). Then the next page will start with Participants’ topics. Developer reserves the right to publish in the book his own article with history, Project description, etc in volume and form in his discretion. He also reserves the right to publish before or after the main part of the book information about himself and Project partners what is not to be considered as advertising.

Each topic is published in volume (size) paid for by Participant. They will be published in order they had been registered. Each topic will consist of registration number granted, its content, full name and author’s country stated when registering and author number in co-authors list with more detailed information.

We propose the following topic format when publishing (can be changed without notice)

- Topic number, - Topic content, -Author Name, Country (co-authors’ list number)

All topics will be published in one font and in one size without any italicizing or accentuation.

All topics are published „as is“, i.e. as they are placed by Participants without translation, shortenings, changes if it is not agreed upon by rules.

Graphical topics will be published in high quality printing available by time of publishing to Developer according to project budget and printing house possibilities.

Developer is obliged to take efforts to publish the book in colour.

By general rules there will be a square of 5 cm in size available for graphical topics. Developer has the right to diminish (reduce) proportionally the original topic size to match it with the stated area. Graphical topics are to be published standard size frame of blue (Red=0, Green=51, Blue= 153 ) 1 point width.

8. Participant’s liability.

Participants are personally liable for content of placed topics.

In case third parties claim to Developer on content Developer has the right to provide third parties with information about Participants who had placed a controversial topic.

9. Developer’s liability.

Developer is liable for fulfilling all present rules and conditions and for complete finishing up the Project.

Liability is limited to amount paid by Participant for taking part in Project. Participant has no right to demand compensation more than amount paid by him/her.

The site functions “as is”, we don’t warrant its correct functioning at every Participant’s. Any action or decision taken by you on providing information on or via the site is your sole discretion and risk.

Developers don’t warrant uninterrupted access to the site or that information provided on or via the site will contain no errors or omissions.

Site and its contents can be out of access temporarily without notice in case of system failure, necessity to maintain or repair it or any other reasons beyond our control.

We’ll try to use all reasonable means to correct errors and omissions as far as it is practically possible once they have been noticed by us.

Developers are not liable for third parties’ actions providing security and functioning the Project in Internet, anyone breaking into the site or attempts to do that. In case of information loss by technical reasons Developers are not liable for its placing in the book. Developers are to do their best to rebuild lost information (by providing possibility to publish your topic one more time in volume paid for). In that case Participant’s refuse to place topic for the second time means topic will be removed from publishing, money paid is not refunded unless Participant proves he had no second chance to place topic.

Force majeure. We are not liable for any failure or sustention or termination of access to the site and its contents because of force majeure circumstances. They include without limitations failure of infrastructure, government interventions, wars, civil commotions, hijackings, fires, floods, accidents, storms, strikes, terrorist attacks, lockouts, industrial affecting our suppliers and us.

We are not liable for any damage caused by any indirect or special circumstances, arising from using the site by you or other Participants contradicting our rules and conditions.

11.

Developers possess all rights for Project, site or (and) any of its parts, information, graphical pictures and texts and their fragments by law.

Without Developer’s written agreement use of any part of Project, site and logo, copying and distributing it and acting in other ways breaking copyrights and Developer’s rights are prohibited.

The only means proving Developer agreed to use secured materials is usual letter sent by post or fax according to which their origin can be clearly defined.

Privacy Policy.

Developer is obliged not to publish in the book

1. any data about Participant not specially marked for publishing or which are not obligatory to publish by present rules ( in any case address with street name, house or flat number, telephone number cannot be published )
2. Participant’s ip-address

Developer has the right to keep confidentially Participant’s data collected through the registration form and ip-address when registering or entering site as a user.

Developer can provide only data and only in cases required by law of the Czech Republic.

Fares for placing topics.

1. Present fares are an integral part of Project’s rules.
2. Present fares are basic (pure) and do not include taxes. Final price for placing to be paid will be shown automatically before passing to processing centre page.
3. All fares are stated in USD
4. Fares are valid from 01.09.2006 till they are changed without notice.

Placing text topics.

Measure unit – 1 line. It can contain up to 50 symbols including gaps and technical symbols. If for instance you press „Enter“ on an empty line it will be regarded as a line no matter how many symbols it contains. Line is counted in any way after reaching 50 symbols in amount.

Minimum topic should contain 5 lines with special signs to mark lines.

Maximum topic – 150 lines with all special signs to mark lines. If you want to publish a bigger in size text contact us at topic@makealive.com and you will be offered individual fare.

Placing graphical topics.

Measure unit – graphical file size. Only size determined by system is taken into account. It will proximate to kilobytes to a larger number. For example, if file size is 608,11 Kb, system will determine it as 609 Kb.

Pay attention that only files up to 1024 Kb (1Mb) can be entered onto site. If your file is bigger, please diminish it or contact us to agree upon placing and fares for it at gtopic@makealive.com. You will be offered individual placement fare.

Invoice delivery

Developer is to deliver by post to your post address an invoice for the payment made on demand. Please agree upon sending invoice necessity at payment@makealive.com.

Appendixes:

1. Any correspondence will be sent to post address stated when registering in Project without special agreement.
2. Invoice will be delivered through Ceska posta s. p. company in English as a usual letter. Developers are not liable for terms and security of delivery.
